Week of 2012 Session
The
2012 session is underway and questions of it’s
productivity can finally be assessed. If you think the
new video game you purchased during the holiday season
is complex, put on your 5D glasses to decipher the
matrix the legislature has cooked up for 2012. Special
session, court drawn new house and senate districts,
poor budget, 2012 elections, the spillover effect from
tension borne by special session between the house
versus the senate versus the governor versus the
business community, and the all our food fight over
rewriting the formula that dictates the amount of state
funds allocated to each local school district.
The legislature will focus on approving a
constitutionally mandated balanced budget, which at the
moment is projected at $750M short, killing or
implementing the Health Exchange mandated by the Federal
Government and business reform issues, such as workers
comp and the 2nd injury fund, and fixing an
upcoming major reshuffle of dollars to local school
districts while keeping an eye on their re-election
efforts.
The relatively rarely called special session in October
exacerbated the division between the House and Senate,
as they could not come to terms on various economic
development proposals. The disagreements between the two
bodies usually have all interim to dissipate, but the
special session ended only 5 weeks shy of 2012 pre
session filing, which began on December 1st,
2011.
Senate President Rob Mayer and Speaker Steven Tilley
outlined their priorities during opening day speeches to
their respective bodies. Both are serving their last
year as a legislator.
Two bills will be heard this week requiring all
administrative rules to sunset, and cause the
departments to re-file to ensure they are still relevant
and necessary. It also gives private industry an
opportunity to comment when the rules are refilled. The
downside is, some rules are good, and they too will be
up for re-promulgation. I will follow this bill, last
year the senate liked the concept, but was not sure that
was the way to clean out the administrative rules that
were out of date.
